Borrowing and borrowing money between friends, business partners, relatives or relatives is common, but good relations risk breaking if the money lent is not paid.
This happened to an actor, internet celebrity and content creator Faizal Abdussalam Khasfi or Faizal Akew who gave his business partner Tran Cong Truong a loan of IDR 100,000,000, who is a Vietnamese citizen.
He told the media that, “I’m tired of billing Tran Cong Truong who often promises to pay within 1 month but he only makes false promises,” he said.
From that, Faizal Akew will take legal action by bringing his lawyer. Faizal Akew will sue Tran Cong Truong because he broke his promise.
Faizal and his lawyer will send a subpoena first to Tran Cong Truong’s home address in Hung Yen Province, Ho Chi Minh City in Vietnam, then the mediation process, if you don’t pay your obligations then go to the court process in Vietnam.
After that, Faizal Akew will use Article 378 of the Criminal Code because it is considered to meet the elements of a series of lies or fraud. The borrower is considered to have no intention of paying but he pretends to have an intention to pay.
In addition, Faizal and his lawyers will sue Article 372 of the Criminal Code regarding (Embezzlement). The debt given can be called embezzled because the borrower does not return the money.
Faizal added, “If I later go to Vietnam and Tran Cong Truong still hasn’t paid for it, then I report it to the Vietnamese state police and I have contacted the Vietnamese police to imprison him with the demands of Article 372 of the Criminal Code on Embezzlement,” he concluded.***
